1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and ClickPost Pro ("Company," "we," "us," or "our"), governing your access to and use of our website at clickpost.pro and all services we provide.

By accessing our website, submitting a form, or purchasing any of our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access our website or use our services.

2. Description of Services

ClickPost Pro provides AI-optimized website design, development, and hosting services for local service businesses. Our services include but are not limited to:

• Full website build including copywriting, page design, and content creation
• AI search optimization structured for Google, ChatGPT, Perplexity, and other AI-powered search engines
• Website hosting and SSL certificate management
• Lead capture integration including contact forms and click-to-call
• Monthly content updates and ongoing maintenance
• Google Business Profile content creation (where applicable)

We reserve the right to modify, discontinue, or update our services at any time. We will provide reasonable notice of any material changes to active subscribers.

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding contract to use our services. By agreeing to these Terms, you represent and warrant that you meet these requirements and that all information you provide is accurate and truthful.

4. Subscription and Payment

Monthly Subscription

Our services are billed on a monthly recurring basis at the rate listed on our website at the time of purchase, currently $97 per month. Your subscription begins on the date of your initial payment.

Billing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. You are responsible for keeping your payment information current.

Failed Payments

If a payment fails, we will attempt to notify you. If payment is not received within 7 days of the due date, we may suspend or terminate your service until payment is brought current.

Price Changes

We reserve the right to adjust pricing with at least 30 days' written notice. Your continued use of the service after a price change constitutes acceptance of the new rate.

5. Cancellation and Refund Policy

Cancellation

You may cancel your subscription at any time by contacting us at [email protected]. Your cancellation will take effect at the end of the current billing period. You will retain access to your website and services through the end of the paid period.

30-Day Satisfaction Guarantee

If we do not deliver a fully built, live website within 30 days of your completed onboarding call, you are eligible for a full refund of your first monthly payment. This guarantee requires that you have completed the onboarding intake questions promptly. Refund requests must be submitted within 7 days of the 30-day deadline.

No Refunds After Delivery

Once your website has been delivered and approved, monthly subscription payments are non-refundable. Cancellation stops future charges but does not entitle you to a refund of amounts already paid.

Website Ownership

Upon cancellation, you may request a static export of your website content. Hosting and ongoing updates will cease at the end of the final paid billing period.

To enable us to build and launch your website, you agree to:

• Complete the onboarding intake questions promptly and accurately
• Provide timely feedback during the review process
• Supply any business-specific content, images, or materials you wish to include
• Maintain accurate billing and contact information with us
• Ensure that all information you provide about your business is truthful and not misleading

Delays caused by incomplete or late intake responses may extend your project timeline beyond our standard delivery window.

8. Acceptable Use

You agree not to use our website or services to:

• Violate any applicable local, state, federal, or international law or regulation
• Engage in fraudulent, deceptive, or misleading business practices
• Represent a business that promotes illegal products, services, or activities
• Transmit spam, unsolicited communications, or malicious software
• Infringe upon the intellectual property rights of any third party

We reserve the right to refuse or terminate service to any client whose business or practices violate these standards.

9. Intellectual Property

Our Content

All website design templates, code frameworks, proprietary systems, and general methodologies created by ClickPost Pro remain the intellectual property of ClickPost Pro. You are granted a limited, non-exclusive license to use the website we build for you as long as your subscription is active.

Your Content

You retain ownership of all business-specific content you provide, including your business name, logo, photos, and any proprietary information about your services. You grant ClickPost Pro a license to use this content solely for the purpose of building and maintaining your website.

Custom Website Copy

Website copy written by ClickPost Pro for your specific business becomes your property upon delivery and full payment. We may use anonymized descriptions of your project for portfolio or marketing purposes unless you request otherwise in writing.

You agree to defend, indemnify, and hold harmless ClickPost Pro, its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any inaccurate information you provided to us.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which ClickPost Pro operates, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or our services shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated to active subscribers via email with at least 14 days' notice. Your continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
